The Evolution of Australian Property Law

1788 - Terra Nullius & Crown Land

Upon British colonisation, Australia was declared 'terra nullius,' meaning 'land belonging to no one,' asserting Crown ownership over all land despite Indigenous presence.

1858 - Torrens System Introduced

South Australia pioneered the Torrens system of land registration, replacing complex deed systems with a central, government-guaranteed title register, simplifying transactions and reducing disputes. This system was gradually adopted nationwide.
